This is the Privacy Policy of the ART4MENTAL project.

The ART4MENTAL project is herein referred to as "ART4Mental" or "we".

This Privacy Policy is intended to inform you about the processing of personal data that takes place via the ART4MENTAL website and/or online or during ART4MENTAL events or activities. This Privacy Policy must be read in conjunction with the Cookie Policy. 

We are committed to protecting your personal data and ensuring transparency in how we process it. Please read our art4mental.com.ua Website Privacy policy to find out how we collect and treat your personal data.  

This Privacy Policy may be modified, for example, in connection with new features on the website or to comply with new legal, contractual or administrative obligations. We therefore recommend that you regularly consult this Privacy Policy. Important changes will be announced on our website. This version of the Privacy Policy was last modified on 6 of May, 2026. 

 

  1. Who is responsible for processing your personal data?

On behalf of ART4MENTAL the controller for the processing of your personal data is charity organisation “Rise of Ukraine” charity fund (herein referred to as "Rise of Ukraine" or “Rise”).

The processing of your personal data can be done by either Rise of Ukraine as controller or by a trusted processor (e.g. third-party companies like IT services providers, hosting providers, etc. to which ART4MENTAL outsources some services involving processing operations in their quality of external data processors) engaged to that end.

  1. Purposes, legal basis and retention of data processing

Purpose of processing and legitimate interests: 

  • Enabling the use of the website and ensuring its proper functioning.
  • Determining and pursuing or defending against claims.
  • Acceptance and consideration of the request based on the GDPR.

Legal basis for processing:

  • The legitimate interest of the data controller (art. 6.1(f) of GDPR).
  • Obligation under the GDPR to provide the data subject with information (art. 6.1(c) of GDPR).

Retention period:

  • Until the limitation period for claims expires, or effective objection is raised.
  • 5 years from the date of completion of responding to the request.

  1. What data do we process?

ART4MENTAL is processing personal information submitted by you in the context of your use of the website application and/or attendance of one or more of the ART4MENTAL events or activities, including exhibitions, educational programs, art therapy sessions, masterclasses, workshops etc and performance of the contracts you have with the ART4MENTAL and/or the projects of the ART4MENTAL.

We may collect and use the following personal data about you:

  • Your name and contact information, including email address and telephone number, job title and company/organisation details.
  • Your responses to surveys and competitions.
  • Any special requirements or points of interest you indicate during your registration to events.
  • ART4MENTAL is also processing certain non-directly identifying data when you visit our website, such as the type of browser you are using, the operating system you are using, your IP address, technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform; information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time); content you viewed or searched for; page response times, download errors.

  1. Why do we process your data? 

For the technical and functional management of the website.

We process personal data for the technical and functional management of our website and to make the website easy to use. By using your data, we can check how our website is used and we can improve its content and layout. This data also allows us to adequately secure our website.

For this, we can process data such as your IP address, the pages you visit, the browser you are using, the sites you visited earlier, and the time and duration of your visit. We do this, for example, by using cookies.

We process these data based on the legitimate interest of ART4MENTAL in providing a well-functioning and secure website.

We process your personal data in order to exercise our rights and fulfill our obligations arising from any agreements concluded between you and ART4MENTAL.

Your personal data may be processed to:

  • enable you to apply for participation in ART4MENTAL programs, projects, educational initiatives, workshops or other activities;
  • review and evaluate your applications, proposals, and submissions;
  • organize, manage and administer your participation in ART4MENTAL projects and programs;
  • provide you with information about ART4MENTAL events, initiatives, educational programs, workshops and community activities that may be of interest to you;
  • send newsletters and updates if you have subscribed to receive them;
  • facilitate communication between you and ART4MENTAL;
  • allow you to publish feedback, reviews, comments or other user-generated content;
  • respond to your inquiries and provide support.

We process your personal data only to the extent necessary for the purposes described above and in accordance with applicable data protection laws.

To this end, we can process data such as your name, your job, your company name, your address, your e-mail address, your preferred language, and specific areas in which you are interested or in which you participate, your correspondence with the ART4MENTAL, and any other personal data you provide that may be relevant to answering your questions.

  1.  Who has access to your personal data?

Controller will transfer personal data only to trusted recipients such as marketing and event agencies, IT service providers, hosting providers, accountants, law firms, postal and courier companies (who process personal data on the controllers’ behalf). 

ART4MENTAL concludes a processing agreement with the parties that have access to personal data for the performance of their services. 

To realize the Project data can be transferred also to Project Partners and European Commission. For some processing activities performed, it is possible that your data is processed outside the European Economic Area. In such cases, we ensure that data transfers comply with GDPR requirements, for example, through the use of Standard Contractual Clauses (SCCs) or other safeguards as required by GDPR.

We do not provide any personal data to other parties except when required under our contractual obligations with ART4MENTAL, by law or by court order.

The Website may contain links to other websites. Such websites may operate independently of the Controller and may not be supervised by the Controller in any way. These websites may have their own privacy policies and regulations, which we recommend that you read.

  1. What rights do you have regarding the processing of your personal data?

Due to the fact that we process your personal data, you have the right to:

  1. request access to your personal data,
  2. demand the rectification of their personal data,
  3. request to remove or limit the processing of your personal data,
  4. request the portability of your personal data (i.e., to receive your data in a structured, commonly used, and machine-readable format and transmit it to another controller),
  5. complain with the supervisory authority (https://edpb.europa.eu/about-edpb/about-edpb/members_en).

You also have a right to object to processing of your personal data for all purposes indicated above (according to the Article 21 of GDPR).

When the processing of your personal data is based on your consent, you may revoke this at any time. Revocation of your consent does not affect the lawfulness of the processing based on consent before withdrawal.

8. Where does the Controller obtain data?

As a rule, the Controller obtains data directly from you. If we obtain data from another source, you will be informed separately and clearly.

9. How do we protect your personal data and how long do we keep your personal data?

ART4MENTAL takes reasonable security measures to protect your personal data from destruction, loss, modification or any other unauthorized processing. ART4MENTAL does not store your personal data for longer than necessary for the purposes for which it is stored. Typically, due to the requirements of the Grant Agreement and the European Commission, it is 5 years from the end of the Project.

10. Is providing data voluntary?

Providing data is generally voluntary. Whenever data is provided:

  • voluntary, but necessary to achieve specific purposes (e.g. e-mail contact via an online form) or
  • obligatory (e.g. it will result from legal provisions)

you will be informed about this separately and clearly (e.g. on the form through which personal data will be collected).

Data Privacy Statement for the use of Google Analytics

This website utilizes Google Analytics, a web analysis service from Google Inc. ("Google"). Google Analytics makes use of what are known as “cookies”: text files that are saved on your computer and make it possible to analyze website usage statistics through your use.
